Terms of Use

These Terms of Use govern your access to domdigitalgroup.us and any DOM Digital Group landing page, form, or online material (the "Site"). By using the Site you accept these terms. If you do not agree, do not use the Site.

1. Eligibility

The Site is intended for business use by people 18 or older. By submitting a request you confirm that you are 18 or older and that you are authorized to act for the business you name.

2. What the Site is and is not

The Site describes our paid media services and lets you request contact. Nothing on the Site is an offer to enter a contract, a guarantee of availability, or professional legal, financial, tax, or accounting advice.

Any engagement between you and DOM is governed by a separate written services agreement or proposal. If that agreement conflicts with these terms, the agreement controls for the services it covers.

3. No guarantee of results

Case studies, performance figures, testimonials, and examples on the Site describe past outcomes for specific clients and are not a promise or projection of what you will achieve. Advertising results depend on your budget, market, offer, sales process, platform policies, and factors outside our control. We do not guarantee any particular number of leads, cost per lead, revenue, or return on ad spend.

4. Intellectual property

The Site and its content, including text, layout, design, graphics, logos, and the DOM Digital Group name and marks, are owned by DOM or its licensors and protected by United States and international law. You may view and print pages for your own evaluation. You may not copy, republish, sell, frame, scrape, or create derivative works from the Site without our written permission.

5. Acceptable use

You agree not to:

  • Submit false information or another person's contact details without authorization.
  • Use the Site for spam, unlawful, deceptive, or infringing activity.
  • Interfere with the Site, probe it for vulnerabilities, or bypass any security or rate limit.
  • Use bots, scrapers, or automated tools to collect data from the Site.

6. Submissions and electronic communications

Information you submit is handled under our Privacy Policy. By providing your phone number you consent to calls, SMS, and WhatsApp messages as described there; reply STOP to opt out of texts. Any ideas or feedback you send us are non-confidential, and you grant us a perpetual, royalty-free license to use them without compensation.

You agree to receive notices and agreements from us electronically, and that electronic signatures and records satisfy any legal requirement for a signature or writing.

7. Third-party platforms and links

The Site links to and relies on third-party services, including Meta, Google, WhatsApp, and scheduling tools. We do not control those services and are not responsible for their content, availability, policies, or actions, including account or ad-account decisions they make.

8. Disclaimer of warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by law, DOM disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be uninterrupted, secure, error-free, or accurate.

9. Limitation of liability

To the fullest extent permitted by law, DOM and its owners, officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunity, arising from your use of the Site. Our total liability relating to the Site will not exceed one hundred U.S. dollars ($100) or the amount you paid us in the three months before the claim, whichever is greater.

10. Indemnification

You agree to defend, indemnify, and hold DOM harmless from claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your use of the Site, your violation of these terms, or your violation of any law or third-party right.

11. Governing law and dispute resolution

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.

Any dispute arising from the Site or these terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Orange County, Florida. Either party may bring a qualifying claim in small-claims court instead. Claims must be brought individually; class, collective, and representative actions are waived. If arbitration is held unenforceable, the state and federal courts located in Orange County, Florida have exclusive jurisdiction, and both parties waive trial by jury.

12. Changes, severability, and contact

We may update these terms at any time; the version posted when you use the Site applies. If a provision is unenforceable, the rest remains in effect. These terms, with our Privacy Policy, are the entire agreement about your use of the Site.
